CONTRACT PRICE CLAUSE

“It is noted and agreed that in respect of goods sold but not yet delivered for which the Insured is responsible and with regard to which under the written or printed conditions of sale the Sale Contract is cancelled by reason of the loss or damage indemnified by this Policy either wholly or to the extent of the loss or damage, the liability of the Insurer shall be based on the contract price, and for the purpose of average the value of all goods, to which this clause would in the event of loss or damage be applicable shall be ascertained on the same basis.”


Klause Harga Kontrak (Contract Price Clause) seperti yang dijelaskan memiliki ketentuan yang mengatur tanggung jawab perusahaan asuransi terkait dengan barang yang telah dijual tetapi belum dikirim, dan di mana tanggung jawab tersebut beralasan dibatalkan berdasarkan kondisi penjualan tertulis atau dicetak karena kehilangan atau kerusakan yang dijamin oleh polis ini.

Jika gudang perusahaan mengalami kebakaran sebelum pengiriman komputer tersebut kepada pelanggan, dan sebagai hasilnya kontrak penjualan dibatalkan, perusahaan asuransi akan membayar klaim berdasarkan harga kontrak yang telah disepakati untuk komputer-komputer tersebut.

Jika harga kontrak untuk seluruh serangkaian komputer tersebut sebesar IDR 100.000.000, dan karena kebakaran hanya setengah dari komputer tersebut yang rusak, maka perusahaan asuransi akan bertanggung jawab untuk membayar ganti rugi sebesar IDR 50.000.000, sesuai dengan setengah dari nilai kontrak. Dengan demikian, klause harga kontrak menetapkan dasar perhitungan ganti rugi yang didasarkan pada harga kontrak yang telah disepakati sebelumnya.

The Contract Price Clause, as described, contains provisions that govern the insurance company’s liability regarding goods that have been sold but not yet delivered, and where such liability is reasonably canceled based on written or printed sales conditions due to the loss or damage covered by this policy.

In this regard, the insurance company’s liability will be based on the contract price. For the purpose of averaging, the value of all goods that would be applicable to this clause in the event of loss or damage will be determined on the same basis.

Example: For instance, an electronics company sells a series of computers to a customer, and the sales contract includes a contract price clause. If the company’s warehouse experiences a fire before delivering the computers to the customer, leading to the cancellation of the sales contract, the insurance company will pay the claim based on the agreed contract price for those computers.

If the contract price for the entire series of computers is IDR 100,000,000. and due to the fire, only half of the computers are damaged, then the insurance company will be liable to pay compensation of IDR 50,000,000 corresponding to half of the contract value. Thus, the contract price clause establishes the basis for calculating compensation based on the previously agreed contract price.
